Safe Harbor / Puerto Salvo

Our company has formally registered with and notified the United States Department of Commerce that we adhere to the safe harbor framework developed by the Department of Commerce in coordination with the European Commission. Our self-certification to the safe harbor list, and its appearance on this list pursuant to the self certification, constitute a representation to the Department of Commerce and the public that it adheres to a privacy policy that meets the safe harbor framework.  Nuestra compañía se ha registrado y notificado al Departamento de Comercio de Los Estados Unidos de America que adherimos a los convenios de Puerto Seguro desarrollado por el Departamento de Comercio en con la Comisión de las Comunidades Europeas.  Nuestra auto-certificacion e inclusion en la lista segura del convenio conforme a la certificación requerida y constituye una representación al Departamento de Comercio y al público que nuestra empresa adhiere a una política de privacidad que cumple con los requisitos del convenio Puerto Seguro.

If a relevant self-regulatory or government enforcement body finds an organization has engaged in a persistent failure to comply with the principles, then the organization is no longer entitled to the benefits of the safe harbor. In this case, the organization must promptly notify the Department of Commerce of such facts either by email or letter. Failure to do so may be actionable under the False Statements Act (18 U.S.C. 1001). That organization must also provide the Department of Commerce with a copy of the decision letter from the relevant self-regulatory or government enforcement body. The Federal Trade Commission (FTC), under Section 5 of the Federal Trade Commission Act (15 U.S.C. §§ 41-58, as amended) to take action against those who fail to protect the privacy of personal information in accordance with their representations and/or commitments to do so. It also addresses the exceptions to that authority and the ability of other federal and state agencies to take action where the FTC does not have authority.(1) Klatu is subject to the review and directives of the FTC under this mechanism.

Any dispute that cannot be resolved in a mutually satisfactory manner may be submitted to confidential arbitration in Florida, and shall be conducted under the rules then prevailing of the American Arbitration Association.
